Terms &Condition

1. Acceptance

1.1 Givart (referred to as Givart, we, our, or us) permits users (referred to as you or your) to:
(a) access and use the Givart website (shop.givart.org) (Website);
(b) place an order for products or services (including art, merchandise, and other items offered for sale through the Website) (Order) through our online store (Store);
(c) view and interact with any content, information, communications, advice, text, or other material provided by Givart (Content); and
(d) otherwise communicate with Givart,
subject to the following terms and conditions (Terms).

1.2 We may review and update these Terms from time to time, including to account for new laws, regulations, practices, or technology. By using the Website, you agree to these Terms. We will notify you of updates by posting them on the Website or via email. Your continued use of the Website will be governed by the most recent Terms. Please check this page regularly for changes.

2. Orders for Products, Services, or Donations

2.1 By placing an Order via the Store, you are making an offer to purchase products or services in accordance with these Terms. An Order is subject to acceptance or rejection by Givart at our discretion. If your Order is not accepted, you will receive a notification.

2.2 Once you place an Order, you will receive an email confirming the details of your Order and payment shop.support@givart.org. If you do not receive a Confirmation Email, please contact Givart Support to check the status of your Order.

2.3 We reserve the right to accept, decline, or limit your Order for any reason, even after payment has been processed. If we cancel your order, we will issue a refund if  payment has been made.

2.4 Givart does not accept Orders with delivery addresses outside the specified service areas.

2.5 Products purchased from Givart are for personal use only and may not be resold.

2.6 Production and Fulfillment Partnership
 All apparel and merchandise sold through the Givart Store are printed, produced, and fulfilled by our official production partner, Prints & Daggers. Prints & Daggers manages the printing, packaging, and international shipping of all customer orders on behalf of Givart. By placing an Order, you acknowledge and consent that your purchase details will be shared with Prints & Daggers solely for order fulfillment purposes.

3. Changes to Products, Services, and Pricing

3.1 We may modify prices, and product offerings options at our discretion due to changes in market conditions, availability, or other factors.

3.2 All updates to the Website, including changes to Content, product availability, and pricing, are subject to these Terms. We are not liable for any lack of availability of products or services.

4. Payments

4.1 Payment for Orders is made online through the Store.

4.2 All prices are displayed in the local currency of the user’s region.

4.3 We use secure payment gateways to process transactions. For more information on payment security, please visit the payment provider’s website.

4.4 We accept payments via credit/debit cards (VISA, MasterCard, GooglePay), PayPal, and other methods as specified at checkout.

4.5 If payment cannot be processed, your Order may be canceled.

4.6 You must not use fraudulent or unlawful means to make payments.

4.7 A receipt will be provided upon confirmation of your Order.

4.8 All payments are subject to security and verification processes. We may request additional information to verify your identity or payment method before processing your Order.

5. Risk and Title

5.1 For Orders delivered via third-party couriers:
(a) Title to the products passes to you upon delivery.
(b) Risk of loss or damage passes to you when the Order is dispatched from Prints & Daggers’ premises or partner facilities.

5.2 Givart and Prints & Daggers are not responsible for delays caused by customs, courier services, or events beyond our reasonable control.

6. Returns and Refunds

6.1 Returns for Change of Mind
Givart accepts returns for eligible products within 21 days of receipt, provided:
(a) The item is unused, undamaged, and in its original packaging.
(b) Proof of purchase is provided.
(c) The item is not marked as non-returnable (e.g., custom or personalized items).

6.2 Faulty or Damaged Items
If an item is faulty or damaged, please contact Givart Support. We will offer a repair, replacement, or refund in accordance with applicable consumer laws.

All replacement and return shipments will be coordinated in partnership with Prints & Daggers, our printing and logistics partner.

6.3 Donations
Donations are non-refundable unless required by law.

7. Gift Cards

7.1 Gift cards can be redeemed for products or services through the Store.
7.2 Gift cards are valid for 1 years from the date of issue and cannot be reloaded or exchanged for cash.
7.3 Lost or stolen gift cards cannot be replaced.

8. Privacy

8.1 Your personal information is collected and used in accordance with our Privacy Policy. This includes processing payments, fulfilling Orders, and sending updates about Givart’s activities.
8.2 To ensure fulfillment, your shipping and order details may be securely shared with Prints & Daggers, our official printing and logistics partner, solely for the purpose of producing and delivering your order.
8.3 By using the Website, you consent to the collection and use of your information as described in our Privacy Policy.

9. Intellectual Property

9.1 All Content on the Website is protected by copyright and trademark laws.
9.2 You may not reproduce, distribute, or use any Content without Givart’s written permission.
9.3 User-generated content shared with Givart (e.g., via social media) may be reposted or used for promotional purposes.

10. Limitation of Liability

10.1 Givart and Prints & Daggers are not liable for any indirect, incidental, or consequential damages arising from your use of the Website or delays in product fulfillment due to external shipping factors.
10.2 Our liability is limited to the resupply of products or services or the refund of payments made.

11. Third-Party Links

The Website may contain links to third-party sites. Givart is not responsible for the content or operation of these sites.

12. Termination

Givart may terminate or restrict your access to the Website at any time for any reason, including breach of these Terms.

13. Governing Law

These Terms are governed by the laws of New Zealand. Any disputes will be resolved in the courts of New Zealand.
